  • Having Blood Alcohol Content (BAC) of .08% or higher or other evidence of intoxication and driving a non-commercial motor vehicle
  • Having Blood Alcohol Content (BAC) of .04% or higher or other evidence of intoxication and driving a commercial motor vehicle

Aggravated Driving With Impairment (DWI)

  • Having a Blood Alcohol Content of .18% or higher

There are multiple levels of DUI/DWI offenses in New York State, and each carries different fines and penalties depending on the severity of the charge. Almost all DWI convictions are misdemeanors and some are felonies.

  • A first aggravated DWI conviction can lead to up to 1 year in jail, $1,000‑$2,500 in fines, and a mandatory license revocation of at least 1 year.
  • A second aggravated DWI conviction within 10 years can lead to up to 4 years in jail, $1,000-$5,000 in fines, and a mandatory license revocation of at least 18 months.
  • A first DWI conviction can lead up to 1 year in jail $500-$1000 in fines, and a mandatory license revocation of at least 6 months.
  • A second DWI conviction within 10 years can lead to up to 4 years in jail, $1,000-$5,000 in fines, and a mandatory license revocation of at least 1 year.
